1. Introduction These Terms of Service ("Terms") govern your access to the Shift Fashion Group website and your purchase of products from Shift Fashion Group Asia Ltd, a company registered in Hong Kong ("we," "us," "our"). By using the site or placing an order, you agree to these Terms. If you do not agree, please do not use the site or place an order.
2. Eligibility You must be at least 18, or the age of majority in your jurisdiction, and able to form a binding contract. By ordering, you confirm the information you provide is accurate and that you are authorized to use the payment method you submit.
3. Products We currently offer one product, The Black T-Shirt, in a single color and in sizes S through XXL. We work to display the product and its specifications accurately, but screen settings and photography mean actual color and appearance may vary slightly. Measurements and specifications are provided as a guide.
4. Pricing and payment Prices are shown in US dollars unless stated otherwise: $68 for a single shirt, $180 for the 3-Pack, and $280 for the 5-Pack. We may change prices at any time, but changes do not affect orders already placed. You are charged in full when you place your order, including for orders that ship in a later batch or as a preorder (see Section 6). If we discover an error in a price or description, we may cancel the affected order and refund you in full, even after the order is confirmed.
5. Orders and acceptance Your order is an offer to buy. We may accept or decline any order, and may limit or cancel quantities purchased per person or per order. If we cancel an order after you have been charged, we refund you in full. An order confirmation email confirms we received your order, not that we have accepted or shipped it.
6. Preorders, batches, and ship dates The Black T-Shirt is produced in batches. Depending on availability of your size when you order, your order may be fulfilled from a current batch, a later batch, or as a preorder for a future run. The ship date or window for your size is shown on the product page and at checkout before you buy. You are charged at the time of purchase, not at shipment. Batch and preorder dates are good-faith estimates and may shift due to production or logistics; if a date changes materially we will let you know. You may cancel any order for a full refund at any time before it ships, through the Support page. Once an order ships, our Return and Refund Policy applies.
7. Shipping Shipping, delivery times, and duties are described in our Shipping Policy, which forms part of these Terms.
8. Returns, exchanges, and cancellations These are governed by our Return and Refund Policy, which forms part of these Terms.
9. Intellectual property All content on this site, including the brand name, logos, text, images, video, and the documentary film, is owned by us or our licensors and protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content without our prior written permission.
10. Acceptable use You agree not to use the site for any unlawful purpose, interfere with its operation or security, attempt unauthorized access, or misuse promotions or discounts, including by structuring orders to obtain pricing or shipping benefits you are not entitled to. We may cancel orders or restrict access where we reasonably believe these Terms have been breached.
11. Disclaimers The site and products are provided on an "as is" and "as available" basis to the fullest extent permitted by law. We do not warrant the site will be uninterrupted or error-free. Nothing in these Terms excludes or limits any rights you have under mandatory consumer protection laws in your jurisdiction.
12. Limitation of liability To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the site or products. Our total liability for any claim relating to an order is limited to the amount you paid for that order. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
13. Indemnification You agree to indemnify and hold us harmless from claims, losses, and expenses arising out of your breach of these Terms or misuse of the site.
14. Governing law and disputes These Terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict of law rules. Any dispute will be subject to the courts of Hong Kong, except where mandatory local consumer law gives you other rights.
15. Changes to these Terms We may update these Terms from time to time. The version in effect when you place an order applies to that order. Continued use of the site after changes means you accept the updated Terms.
